July Official Contest Rules

By participating in this online promotion (the "Contest), you agree to be bound by these Official Contest Rules and represent that you are of legal age and satisfy all the eligibility requirements.

1. Sponsor: This Contest is being sponsored by DeafVision, Inc. (hereafter referred to as "DeafVision"). DeafVision can be contacted via the following mailing address: P.O. Box 14431, San Francisco, CA 94114 or by fax at (415) 449-3674.

2. Eligibility: NO PURCHASE NECESSARY TO ENTER OR WIN THIS CONTEST.

To enter this Contest:

(a) you must be a registered and active member of Facebook (in compliance with the Facebook's Terms of Use)

(b) be a member of DeafVision's Facebook Group Page (located at http://www.facebook.com/group.php?gid=41976969849 )

(c) must be 18 years of age or older

(d) be a legal resident of one of the 50 United States or the District of Columbia



Employees and immediate family members of DeafVision are ineligible. This Contest is void where taxed, restricted or prohibited by law.

3. Contest Period: Start the New Year with DeafVision! July Contest commences on July 15, 2009 at 11:30 PM Pacific Time and ends on July 31, 2009 at 11:30 PM Pacific Time.

4. Winner Selection: DeafVision will choose one person RANDOMLY from DeafVision's Facebook Group Page. If person chosen meets all eligibility requirements, that person will be declared the Winner of this Contest. The odds of winning depend on the number of eligible entrants.

DeafVision will use randomization methods selected at its sole discretion. By entering this Contest, you agree that DeafVision has the sole right to decide all matters and disputes arising from this Contest and that all decisions of DeafVision are final and binding.

5. Notification: Winner will be notified before midnight Pacific Time, July 2, 2009, by Facebook message (Facebook's built-in email messaging system). Winner must respond to message within 48 hours of notification or prize may be forfeited and another Winner may be selected based on the above criteria.

6. Prize: The Winner will receive a) 1 year of Apollo Web Hosting (including setup) and b) 1 year of domain name registration services (a .com, .net or .org domain). Prize is valued at $255.40 US. All federal, state and/or local taxes are the sole responsibility of the Winner. In order to claim prize, Winner must sign up for the account at http://www.deafvision.net/webhosting within 30 days of prize notification date and agree to DeafVision's Terms of Services as outlined at http://www.deafvision.net/policies/tos.

7. Publicity Release: By participating in this Contest, you irrevocably grant DeafVision the right to use your name, likeness, photo and biographical information in any and all media for any purpose, including without limitation, advertising and promotional purposes, without further payment or consideration, and hereby release DeafVision from any liability with respect thereto. You also agree to provide a photography (in jpeg or gif format) and a one to two paragraph biography about yourself within 48 hours of prize notification.

8. General: Contest judging will be carried out by DeafVision. No participant or potential Winner shall have the right to contest any decision by DeafVision concerning any aspect of the Contest. By participating in this Contest, you agree to be bound by these Official Contest Rules.

DeafVision reserves the right to cancel/terminate, modify or suspend the Contest for any reason, including if in DeafVision's sole determination it believes that the integrity of the Contest has been, or could be, compromised or that the Contest is not capable of running as planned or fairly, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or force majeure or any other causes beyond DeafVision's control.

DeafVision reserves the right to disqualify any entry from the Contest if in DeafVision's sole judgment it suspects that entrant has not complied with these Official Contest Rules. Without limitation, all of an entrannt's entries will be disqualified, at the sole discretion of DeafVision, if DeafVision suspects that an entrant attempts (i) to enter the Contest through any means other than as described in these Official Contest Rules; (ii) provides information that is inaccurate or fraudulent; or (iii) attempts to disrupt the Contest or circumvent the terms and conditions of these Official Contest Rules. Neither DeafVision nor Facebook assume any liability for damage caused to entrant's or any other person's/entity's computer hardware, software or communications network, regardless of cause. Only the prizes and the respective values listed in the Official Contest Rules shall be awarded. The Contest Entities (i) make no warranty, guaranty or representation of any kind concerning the prizes; and (ii) disclaim any implied warranty. Only the number of prizes listed in the Official Contest Rules shall be awarded if claimed properly. Prizes are non-transferable and no substitutions, exchanges or cash equivalents will be allowed, except by DeafVision who, due to lack of availability or force majeure, may substitute a prize of equal or greater value.

By entering this Contest, you explicitly release and hold harmless DeafVision and it's employees from any and all liability, actions, causes of action, damages, actual, incidental or consequential, claims and demands whatsoever in law or equity, including all "costs", which you now have or may acquire, by reason of any personal injury, death, loss of or damage to property, or any reason, occurring during or arising out of your participation in the Contest and the acceptance and use or misuse of the prize. Prizewinner waives the right to claim any liability (including attorney's fees and costs) which might arise from redeeming or seeking to redeem said prize.

If any provision of these Official Contest Rules shall be deemed to violate any local, federal, state or municipal law, it shall be amended to conform to such law and all other provisions shall remain in full force and effect.

9. Disputes: As a condition of participating in this Contest, you agree that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, or the determination of the Winner shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, and you further waive all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, or your rights and obligations or DeafVision's rights and obligations in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A., without giving effect to the conflict of laws rules thereof, and all proceedings shall take place in that State in the City of San Francisco.

10. Winner Announcement: The Winner will be announced on DeafVision's Facebook Fan Page sometime between August 1, 2009 and August 31, 2009.
